In accordance with the disclosure requirements of Article 12 of Law no. 247/2012 and the Ministry of Justice Decree of 22 September 2016 (as amended by the Ministry of Justice Decree of 10 October 2017), details of Linklaters LLP and its affiliate Studio Legale Associato’s compulsory insurance in Italy are as follows. Japan

Linklaters’ Tokyo office is a partnership formed pursuant to the Japanese Civil Code under the name “Gaikokuho Kyodo-Jigyo Horitsu Jimusho Linklaters” whose business name is "Linklaters Tokyo". Linklaters Tokyo is affiliated with Linklaters LLP, a law firm authorised and regulated by the Solicitors Regulation Authority of England and Wales (SRA ID 460682). The office provides integrated Japanese and English law advice.

The Japanese legislation regulating the practice of lawyers (the Practising Attorney Law for bengoshi and the Special Measures Law concerning the Handling of Legal Business by Foreign Lawyers for gaikokuho jimu-bengoshi) permits Japanese-qualified lawyers (bengoshi) to form a partnership with only those non-Japanese lawyers who are registered foreign lawyers in Japan (gaikokuho jimu-bengoshi). In accordance with this legislation, the Linklaters Tokyo office is organised as a local partnership whose partners comprise only Japanese-qualified lawyers (bengoshi) and those Linklaters LLP partners who are registered foreign lawyers in Japan (gaikokuho jimu-bengoshi). Although technically separate from the global firm due to the regulatory reasons described above, Linklaters Tokyo will continue to operate as an integral part of Linklaters global network.

Spanish Lawyers (abogados) are regulated in their professional practice by the General Rules for Lawyers (Estatuto General de la Abogacía Española) and the Spanish Lawyers Code of Conduct (Código Deontológico de la Abogacía Española) which is based on the European Code Of Conduct (Código Deontológico Europeo). Apart from the above, Spanish Lawyers (abogados) are subject to other provisions like the Organic Law of the Judicial Power (Ley Orgánica del Poder Judicial), the Code Governing Publicity of Lawyers of the Madrid Bar Association (Código Regulador de la Publicidad de los Abogados del Colegio de Madrid), and the Disciplinary Regulation (Reglamento del Procedimiento Disciplinario). The General Rules, Code of Conduct and Disciplinary Rules referred to above also apply to other European lawyers practising in Spain in accordance with European Directive 98/5/EC.

In order to be allowed to practise law, Spanish lawyers (abogados) must be registered with the Bar Association of their local jurisdiction in Spain. All Spanish lawyers (abogados) in Linklaters’ Madrid office are members of the Madrid Bar Association.

Complaints

Linklaters is committed to delivering an outstanding service to our clients. If you are a client and are dissatisfied with any element of our service (including about your bill), you should contact your relationship partner responsible for the Transaction, the head of the relevant department or the Firm’s General Counsel who will be happy to discuss the matter with you and, if applicable to the Transaction, initiate our Client Complaints Procedure (a copy of which will be sent to you on request).

If for any reason we are unable to resolve this, you may contact the Legal Ombudsman (PO Box 6806, Wolverhampton WV1 9WJ, UK; tel: 0300 555 0333; email: enquiries@legalombudsman.org.uk), which deals independently with complaints against lawyers registered in England and Wales. The Legal Ombudsman will check that you have tried to resolve your complaint with us first. If you have, then you must take your complaint to them:

  • Within six months of receiving a final response to your complaint; and
  • No more than six years from the date of act/omission; or
  • No more than three years from when you should reasonably have known there was cause for complaint.

In accordance with the disclosure requirements of the Provision of Services Regulations 2009, details of Linklaters LLP’s compulsory professional indemnity insurance in England and Wales are as follows. Our participating insurer is QBE Europe SA, 30 Fenchurch Street, London EC3M 3BD. This insurance covers the London practice of Linklaters LLP, and will extend to acts or omissions wherever in the world they occur.

Our insurance programme is provided by multiple insurers, including various underwriters at Lloyd’s, London, and other commercial professional indemnity insurers.
