French Competition Authority censured: Paris Court of Appeal reduces fines imposed on steel products cartel by more than €500m

Linklaters advised ArcelorMittal on their action before the Paris Court of Appeal against a landmark December 2008 Decision of the Conseil de la concurrence concerning the steel products cartel.

This Decision, which led to the heaviest sanctions ever imposed in France - both individual and total amounts (€575m) - has been extensively modified by the Court; the total amount of the fines was reduced eight-fold (down to €72m). Notably, the Court considered that the seriousness and the impact of the cartel had been "moderate" which did not justify such heavy sanctions in proportion to the turnover of the companies directly involved in the procedure.

In its decision of 19 January, the Court reduced the fine (€302m) imposed on ArcelorMittal by 85%, their fine now being limited to less than €42m.
