On November 17, 2023, the Internal Revenue Service (the “IRS”) issued proposed regulations (the “Proposed Regulations”) updating treasury regulations under Section 48 of the Internal Revenue Code of 1986, as amended (the “Code”), regarding investment tax credits (“ITCs”) for renewable energy projects, to account for changes made under the Inflation Reduction Act of 2022 (the “IRA”).
