Experience

Elizabeth is a Counsel in the Competition Litigation team. She has wide-ranging experience advising corporates and financial institutions on contentious matters, particularly in relation to competition and EU law issues.

Elizabeth has extensive experience in the conduct of complex, high-value competition litigation before both the English High Court and Competition Appeal Tribunal. She also regularly advises clients in connection with competition investigations.

Elizabeth has recently represented leading corporates in "follow-on" competition damages actions commenced in the English High Court in respect of the synthetic rubber, paraffin wax, copper fittings and industrial bags cartels. She also acted for a leading UK energy company in two inter-related damages actions before the Competition Appeal Tribunal arising in respect of abuse of dominance in the gas metering market.

She is currently acting for defendants in a large number of high-value proceedings (involving claims in excess of £1 billion) related to the air cargo cartel and to the alleged antitrust infringements concerning interchange fees, as well as a damages action related to the alleged cathode ray tube cartel.

Matter examples:

  1. card fees: acting for a leading card payment system operator in numerous "stand alone" proceedings brought by major retailers who allege that multilateral interchange fees on card transactions were levied in breach of Article 101 TFEU (and various domestic competition laws) and that they have suffered loss as a result. 30 years' of claims struck out on limitation grounds following successful summary judgment strategy, upheld on appeal
  2. synthetic rubber: defending a leading chemicals manufacturer in the first follow-on damages proceedings to go to trial before the English High Court (after initial skirmishes involving novel jurisdiction issues), which were brought by leading tyre manufacturers in reliance on the European Commission's 2006 synthetic rubber cartel decision
  3. air cargo: representing three major airlines in multiple sets of damages actions relating to the air cargo cartel before the English courts, involving large numbers of claimants from diverse sectors. The cases raise a number of novel points of law, some of which have been the subject of successful appeals before the Court of Appeal
