Overview

José Maria Sacadura is a Managing Associate in the Tax department of the Lisbon office. Relevant experience includes assisting multinational groups, private equity, hedge and sovereign wealth funds (both at fund and portfolio companies’ level), and high net worth individuals with the structuring and funding of inbound and outbound projects, including respective prospective analysis / due diligence, setting up, day to day, reorganisations and exit (e.g. via IPOs). Further highlights include drafting and reviewing transactional, financial and commercial documentation, such as sale and purchase agreements, loan agreements, prospectus, ISDA financial instruments and intragroup services agreements.            
                               
José also provides advice regarding cross-border value chain structures, intangibles and permanent establishment planning, treaties and EU directives, coordination of transfer pricing policies and general tax compliance.

He has specific knowledge and experience in several markets such as Europe, US, China and Portuguese-speaking countries, including Brazil, Angola and Mozambique.

Professional experience

Over the past 10 years José worked in top tier law firms and consultant firms in Portugal, Luxembourg and the USA. This experience allowed him to better understand the challenges and needs of clients at all the levels of an investment structure, i.e. from an investors, holding and target jurisdictions´ perspective.

José started his career in 2008 working as Tax Lawyer at the law firm CMS-Rui Pena & Arnaut in Lisbon, Portugal. He then worked as Tax Lawyer at the law firm Uría Menéndez-Proença de Carvalho, in Lisbon, Portugal. Driven to also obtain working experience in a holding jurisdiction José then worked at the law firm Stibbe Avocats in Luxembourg, Luxembourg. Next José wanted to explore working in an investors jurisdiction and therefore worked as Tax Consultant at Pricewaterhouse Coopers in New York, USA.

José joined the Linklaters Lisbon Office in 2018 as Associate in the Tax Department.

José has been recommended by Legal 500 (2013, 2014) and the Tax Directors Handbook (2014, 2015).

José is a member of the US-Portugal, US-Luxembourg and Luxembourg-Portugal Chambers of Commerce.

Over the years, José has often embraced volunteerism and collaborated with religious and humanitarian institutions having among others done volunteer work in an orphanage in Kenya.

Education and qualifications

José studied law at the Law School of the Lisbon University, and obtained a Master in Law & Business, at Lisbon Catholic University with a thesis on “The taxation of derivatives under corporate income tax”. He furthermore attended Advanced Post Graduated Studies on Corporate Income Tax at Lisbon University, and obtained an International Tax LL.M.at New York University.

He speaks Portuguese, English, French and Spanish.
