Linklaters contributes to Getting the Deal Through – Investment Treaty Arbitration

Linklaters’ Dispute Resolution team has contributed to the 2019 edition of the Getting the Deal Through – Investment Treaty Arbitration. The Guide is a practical cross-border insight into investor-state arbitration’s legislation, practice and trends in key jurisdictions around the world.

Our Brussels office (Françoise Lefèvre, Xavier Taton, Guillaume Croisant and Nicolas Delwaide) has authored the Belgian chapter of the Guide, which answers 31 questions on topics including the procedural and substantive protections offered to foreign investors, past investment treaty claims against Belgium, and enforcement of awards in the Kingdom.

The Chapter also presents the potential impacts of the CJEU’s Achema ruling (read here for a presentation of the case, and here for the additional remedies offered by EU law and the ECHR), and of Belgium’s request for a CJEU’s opinion on the compatibility of CETA’s Investment Court System with EU law (Opinion 1/17).
