Insolvency Bitesize - April 2018

Welcome to the latest edition of Insolvency Bitesize. The Government has published a consultation on Insolvency and Corporate Governance in the wake of recent high-profile corporate collapses. Some of what is proposed is far reaching, although at this stage, it is light on detail. We take a look in this edition.

We also consider two issues that just don’t seem to ever go away – the future of pre-packs and the location of COMI. We highlight how concerns surrounding Brexit are playing out in administration extensions, while we also point to the recent draft Withdrawal Agreement and what it has to say about the continued application of the EU Insolvency Regulation. Finally, we consider a couple of cases raising validity of appointment concerns and new regulations aimed at clarifying the legislative framework applicable to the financial sector special insolvency regimes.
