Pensions Ombudsman Focus 63rd Edition
Welcome to the Pensions Ombudsman Focus for the period to October 2017. In this edition, we cover three recent complaints to the Pensions Ombudsman.
First, we consider a case where a member’s pension was transferred to another scheme, which subsequently went into liquidation. The Pension Ombudsman found that the failure to distribute the Pension Regulator’s ‘Scorpion Pack’ to the member amounted to maladministration, however, as the member would have requested the transfer in any event, the Trustee was not at fault for the loss of his pension monies. Second, we look at a case that considers acceptable business practices in how scheme providers correspond with members.
Finally, we look at a case where deductions of an amount equal to a members Employment Support Allowance were made from a members pension. The Ombudsman upheld the complaint, finding that the scheme was not permitted to make this deduction.
