CLOUD Act Becomes Law

A Compromise that Seeks to Balance Data Privacy and Ease Cross-Border Investigations

On Friday, March 23, 2018, President Trump signed into law an omnibus spending bill to keep the government funded through September. The bill included the Clarifying Lawful Overseas Use of Data Act (“CLOUD Act” or the “Act”). The CLOUD Act fills a critical gap in stored-communications law. Before, there was no law expressly permitting the U.S. government to obtain e-communications stored abroad, or allowing foreign governments to obtain e-communications stored within the United States.
