We understand that, despite the best intentions of businesses, commercial relationships can break down, leading to disagreement and damage. Where the resolution of a dispute requires court proceedings, our global team of nearly 400 lawyers can guide our clients through the technicalities of the litigation process across jurisdictions, drawing on our in-depth knowledge of local procedures to ensure a tactical and efficient approach to each case.

Our team acts for both claimants and defendants in large-scale, high value and complex cases. We work to resolve the high pressure disputes that can arise around high-stakes commercial transactions, enabling our clients to focus on the most important thing - their business. Our lawyers are adept at advising on and resolving issues such as contractual interpretation, joint venture and shareholder disagreements and post-acquisition disputes. We are also called on at the advisory stage to mitigate the risk of litigation and limit the potential loss and disruption to our clients that hard-fought disputes can involve.

Where court proceedings are required, our team will work with experienced advocates, experts and local counsel as necessary to obtain the most favourable outcome for our clients. Our global team can act quickly to seek injunctive relief, should urgent action be needed to protect our clients’ valuable rights or assets. We can also assist when counter-parties abuse the availability of injunctive relief to obtain illegitimate bargaining power and threaten the completion of large and complex transactions.

Where it is apparent that court proceedings may not result in a positive outcome, we will advise on alternative approaches to dispute resolution, including the potential for settlement, meaning our clients can put the issue behind them as quickly as possible and move on.

AXA UK PLC

We advised AXA UK PLC in connection with a claim brought against it under a sale and purchase agreement where proceedings were brought before the High Court.

Bank of New York Mellon SA/NV (BNYM)

We acted in Commercial Court proceedings brought by the Republic of Kazakhstan and the National Bank of Kazakhstan against BNYM (and other defendants). The trial was a landmark case as it was the UK’s first fully virtual trial (necessitated by the COVID-19 national lockdown) and was live streamed on YouTube.

UK Lehman group

We advised the administrators of three companies in the UK Lehman group, in respect of proceedings commenced against them in New York by Lehman Brothers Holdings Inc. Whilst the dispute arose in the context of the Lehman Group, it is at its core a breach of contract claim. This was a complex, high value dispute concerning the proper construction of a settlement agreement, which also involved complex jurisdictional issues.

Glencore International AG

We represented Glencore International AG, one of the world’s leading mining and trading groups, in its defence of a breach of contract claim brought by Minera Las Bambas SA and MMG Swiss Finance AG arising out of the sale by GIAG of a large copper mine in South America. Ultimately the matter settled on confidential terms after five days’ trial after flaws in the Claimants’ disclosure were exposed during the cross-examination of their witnesses.
