OFT publishes guidance to help company directors understand their responsibilities under competition law

On 27 June 2011, the OFT published guidance on how it will assess the extent of an individual director’s responsibility for infringements of competition law. Where a company has breached competition law, the OFT can apply to court seeking a competition disqualification order against an individual director which may be granted if the court considers that the person’s conduct as a director makes him or her unfit to be concerned in the management of a company. The maximum period of disqualification is 15 years. Yesterday’s publication provides high-level guidance on the standards the OFT expects of all directors.
