Brussels Metropolitan Region - Energy Performance Certificates required for the sale of offices (of more than 500m²) and residential buildings as from 1 May 2011

Recently the Brussels government has published three decrees in respect of the need to apply for an Energy Performance Certificate when selling, leasing, vesting a real right or conclude a real estate leasing transaction involving offices or residential buildings.

Below you will find the key dates of the entry into force of these requirements:

As from 1 May 2011:

The sale of residential units and service units which are used as offices or are used to provide services (of more than 500m²) located in the Brussels Metropolitan Region is subject to obtaining an EPC certificate.

As from 1 November 2011:

The lease, the vesting of a real right and the leasing immobilier/ onroerende leasing in respect of residential units and service units which are used as offices or are used to provide services (of more than 500m²) located in the Brussels Metropolitan Region is subject to obtaining an EPC certificate.

As of 1 January 2013 the rules will also apply for the service units which are used as offices or used to provide services (with a surface of less than 500m²) and service units which are not used as offices or used to provide services.
