Chinese SAIC publishes its first AML enforcement decision

The State Administration for Industry and Commerce ("SAIC") recently published on its website details of a case brought by the Administration for Industry & Commerce ("AIC") of Jiangsu Province against a local construction materials and machinery association and its respective members for market sharing. This is the first enforcement decision published by SAIC since the Anti-Monopoly Law (the "AML") came into force in August 2008.

The case is interesting for the way in which enforcement was delegated to the local AIC, and the fact that fines were imposed on members as well as the association, and that the fines were reduced for cooperation with the investigation.
