Supreme Court examines correct approach to contractual interpretation
On 2 November 2011, the Supreme Court handed down judgment in the case of Rainy Sky S.A. (and others) v Kookmin Bank  UKSC 50. The case has attracted attention as the Court of Appeal’s judgment was thought by some to mark a move towards a more literal approach to the construction of contracts under English law. The Supreme Court’s judgment, however, largely represents a reassertion of the purposive approach adopted by previous rulings.
