Covid-19 – alternative methods of dispute resolution

The Covid-19 pandemic is primarily a human and social crisis. It has also placed unique pressures on business conduct and commercial relationships leading to the potential for disputes and, where these disputes cannot be resolved, litigation in court.

However, there are many methods of alternative dispute resolution (ADR) which do not depend on a formal court-room setting. Conciliation, mediation and other forms of ADR are all well-established and may be attractive to litigants in circumstances where litigation may be slower to reach a conclusion.

Mediation, in particular, may provide an effective and efficient way to resolve a dispute or get a commercial relationship back on track, enabling parties to concentrate instead on their business activities in these uncertain times.
