Overview

Marcel represents companies in complex disputes before state courts, in international arbitration proceedings and in out-of-court dispute resolution. He is particularly specialised in insolvency and corporate disputes as well as in enforcement law. In addition, he also advises on energy law and liability issues of a criminal nature.

Work highlights

Marcel has advised major clients on a wide range of disputes. These include representing:

  • a leading energy group in several proceedings relating to long-term power purchase agreements (virtual power plants and asset backed power supply agreements).
  • a leading global gas supplier in a defence against insolvency avoidance claims and comprehensive advice on subsequent enforcement of property rights and their realisation.
  • an international construction company in the enforcement of work contract claims in connection with the dismantling of a nuclear power plant.
  • an international investment bank in insolvency proceedings involving more than 200 defendants in connection with limited partner liability arising from a closed-end real estate fund.
  • an international automotive supplier in a criminal investigation into alleged violations in connection with inadmissible defeat devices in diesel engines.
  • an internationally active custodian bank in potential civil claims for damages by its clients under German law in connection with the replacement and reclaiming of previously issued capital gains tax certificates (Cum-Ex).
  • various insolvency administrators in the procedural enforcement of insolvency avoidance claims and claims arising from directors' liability.

Professional experience

Marcel qualified as a lawyer in 2015 and initially worked for a law firm specialising in insolvency law. He joined Linklaters in 2017 and was appointed Managing Associate in 2020.

He was seconded to a listed industrial services provider for engineering, assembly, maintenance and general inspections and advised in its legal department.

He is a member of the German Institution of Arbitration e.V. (DIS) and the Brandenburg Criminal Policy Association e.V.

Education and qualifications

Marcel studied law at the University of Potsdam, where he worked as a research assistant at a chair for civil law and international business law.

He speaks German and English.
