UK/EU: Applicable law, jurisdiction and recognition of judgments in the UK – the Withdrawal Agreement, transition period, and beyond

This is an updated version of our briefing note, revised to take into account developments (such as the expiry of the period for extending the transition period, and an apparent simplification in the UK’s approach to domestic incorporation of the Hague Choice of Court Convention) since it was published in January 2020. It examines what the UK’s transition out of the EU will mean for the above issues, and the consequent implications for the use of English governing law and jurisdiction clauses.
