Overview

Clark Xue is a Senior U.S. Associate in the firm’s Restructuring and Insolvency Group. He regularly represents U.S. and cross-border corporations, secured and unsecured creditors, and funds, advising on out-of-court restructuring and Chapter 11 bankruptcies.

Clark advises corporations, private funds, asset managers, and banks on all matters relating to Chapter 11 bankruptcies and out-of-court restructurings. In addition, Clark also has experience representing emerging companies in China with respect to listing their shares through an initial public offering in the United States.

Work highlights

Prior to joining Linklaters, Clark was a senior associate in the Corporate Restructuring Group of another large New York law firm, where he advised*:

  • Endo Pharmaceuticals on its Chapter 11 restructuring in the U.S. Bankruptcy Court for the Southern District of New York.
  • (China Fishery Group Limited) William A. Brandt Jr. as Chapter 11 Trustee of CFG Peru Investments Pte. Ltd., a major Peruvian anchovy fishing operation, involving approximately $1.1 billion of debt.
  • CFG Investment S.A.C. on its UK Restructuring Plan which successfully restructured over $1.1 billion of debt.
  • Constellation Oil Services, the ultimate equity holders in Constellation’s Brazilian in-court restructuring proceeding and concurrent Chapter 15 proceeding in the United States.
  • an international offshore drilling company in connection with contingency planning and liability management transactions involving more than $1 billion of debt.

Professional experience

Clark is an active member of several industry organizations, including the New York City Chapter of the Turnaround Management Association (TMA). He also is a member of the New York City Bar Association and Asian American Bar Association of New York.

Education and qualifications

Clark holds a Juris Doctor from Harvard Law School where he was an executive editor of the Harvard International Law Journal. He obtained a Bachelor of Arts with honors in Political Science from Yale University.
