HMT recently published a consultation proposing targeted amendments to the UK Special Resolution Regime (“SRR”) for smaller banks to reflect “lessons learned” from recent bank failures, including that of Silicon Valley Bank UK.
HMT is proposing to amend the SRR so that the FSCS can be required to make a payment to stabilise a smaller bank in resolution, to avoid putting taxpayers’ funds at risk. This overlaps significantly with recent EU proposals.
