Le Patourel v BT: Opt-out collective action can proceed to trial after CAT certifies second CPO

In a unanimous judgment, the Competition Appeal Tribunal (“CAT”) has, for the second time since the UK’s collective action regime was introduced in October 2015, granted a Collective Proceedings Order. The CAT has authorised Le Patourel as the class representative for opt-out collective proceedings for damages against BT for alleged anticompetitive landline services pricing. The claim is brought on behalf of an estimated 2.3 million affected BT customers, with estimated damages of some £469 million plus interest.
