Belgium-Mandatory working from home in Belgium: do you have a compliant teleworking policy in place?

Covid-19 has had an unprecedented impact on the way we work and, most importantly, from where we work. A teleworking obligation for all businesses in Belgium remains in force until at least 1 March 2021, except if this is not possible due to the nature of the employees’ function, the continuity of the business, the activities or the provision of services. The teleworking obligation has resulted in many companies adopting and implementing policies on structural and/or occasional teleworking.


On 26 January 2021, collective bargaining agreement (CBA) n° 149 was published, which provides for the obligation to adopt a teleworking policy specifically aimed at the mandatory teleworking imposed by the government in light of the Covid-19 crisis, for all companies which do not have a (structural and/or occasional) teleworking policy in place as at 1 January 2021. As a result, some employers may need to take action.

  • offer guidance on the steps which employers may need to take to ensure they have a compliant policy in place.
