Dutch Supreme Court offers helpful guidance on subrogation and deferral of rights clauses

On 29 September 2023, the Dutch Supreme Court handed down its verdict in the Melamo case.¹ Whilst fundamentally a case about contractual interpretation, the court provided guidance on subrogation and deferral of rights under Dutch law beneficial to the lending practice.
