Overview

Emeric specialises in prudential regulation and transactional responses to regulatory change. Emeric’s experience includes OTC, exchange-traded and securitised derivatives, margin lending, insurance and structured financial products.

He has advised on the enforceability of netting, set-off and credit support arrangements and the structuring of clearing platforms, with a focus on insolvency and regulatory capital considerations. Emeric also advises on bespoke credit risk mitigation arrangements for financial institutions, pensions funds and insurers.

  • on innovative credit risk mitigation structures (both intra-group and with third parties) for leading financial institutions in the context of the Capital Requirements Regulation
  • on the impact of sanctions on financings, accounts and payment systems
  • financial institutions on regulatory capital optimisation of their cleared derivatives exposures
  • Hong Kong institutions on the Banking Capital Rules and the Securities and Futures (Financial Resources) Rules
  • on loans to UK local authorities and pension funds

Emeric has been seconded to the London offices of a leading Japanese financial institution and Linklaters’ structured finance and derivatives team in Hong Kong. He frequently works on cross-border structures and transactions, particularly with an Asian nexus.
