Overview

Leonard is a managing associate in the Financial Regulatory practice in Amsterdam, and is notably involved in advising inter alia AIFMs, investment firms, banks, financial services providers and payment institutions. He advises on all aspects of financial regulatory law, with a particular focus on market access and anti-money laundering and counter terrorism financing regulations. He assisted multiple clients in the applications of a licence with the Authority for the Financial Markets or the Dutch Central Bank and a number of declarations of no objection with the Dutch Central Bank.

In 2020, Leonard went on a client secondment for 4 months at ING’s DBNL investments department.

Work highlights
  • A UK investment firm: advising on and assisting in the application for a licence in the Netherlands post-Brexit.
  • An AIFM: advising on and assisting in the application for a licence as an AIFM.
  • A Dutch operator of a trading platform: advising on and assisting in the application for a licence as an operator of a multilateral trading platform.
  • An international banking group: advising on and assisting in the application for a licence as an e-money issuer / payment institution.

Professional experience

Leonard started his career as a lawyer with another global leading law firm and joined the Linklaters Amsterdam office as an Associate in 2016. He was promoted to Managing Associate in 2018.

Further experience includes:

  • A Dutch bank: advising on the setting up of a pan-European payment solution.
  • A South African bank: advising on the feasibility of applying for a licence as an investment firm in the Netherlands.
  • A number of investment firms: advising on the feasibility of setting up an operation in the Netherlands as a result of Brexit.
  • Shareholders of various Dutch financial undertakings: advising shareholders of an investment firm, insurance company and payment institution on applications for a DNO.
  • A global bank: assisting the client negotiating its investment services documentation relating to services to a Dutch pension fund.
  • An international group: advising on its intra-group cash pooling structure.

Leonard has been seconded to:

  • Rabobank in 2014; and
  • ING Bank in 2020.

Leonard has given a number of presentations to the Foreign Bankers Association on, amongst others, anti-money laundering and enforcement trends in the Netherlands, the use of artificial intelligence by banks, and the sharing of AML information.

Education and qualifications

Leonard studied at the Leiden University as well as at the Erasmus University and obtained a master’s degree in both notarial law and financial law.

Leonard has completed the Dutch Bar exam and the Law Firm School in 2012 and the Grotius Specialisation Program Securities Law (effectenrecht) in 2015.

Leonard has (co-)authored a number of articles in the Dutch financial regulatory law centred magazine ‘Tijdschrift voor Financieel Recht’, as well as in the ‘Ondernemingsrecht’:

  • FR 2022/12 – 8 December 2022: “Wordt de Europese digitale identiteitsportemonnee dé oplossing voor het cliëntenonderzoek op afstand?”

In this article, which is co-authored by Jan-Jouke van der Meer, discusses the European proposal for a digital identity wallet and how this wallet may be used for the remote onboarding of European clients.

  • FR 2021/12 - 24 November 2021: “De impact van de Wet op de Artificiële Intelligentie op banken”

This article, which is co-authored by Sander van de Ven, discusses the European Commission's proposal for an Artificial Intelligence Regulation and the focus on credit institutions in this regulation.

  • Ondernemingsrecht 2021/39, May 2021: “Brexit en de gevolgen voor grensoverschrijdende financiële dienstverlening” 

This article, which is co-authored by Bas Jennen, discusses the consequences of Brexit for the cross border provision of financial services.
