Alejandro is Head of Latin American Arbitration in the Linklaters Litigation, Arbitration & Investigations practice. He is based in Washington, D.C.
With over 17 years of experience, Alejandro has represented clients in dozens of complex international disputes across industries and jurisdictions involving tens of billions of dollars. This has included investment treaty arbitrations, international commercial arbitrations, mediations, and related disputes and negotiations, with a focus on Latin America.
Alejandro has been described by clients and legal directories as “one of the most recognized lawyers of his generation” with “outstanding personal and professional qualities that set him apart in the field.” He is praised for being “business oriented”, “client focused” and “devoting himself entirely to his client’s cases”. Alejandro “checks all the boxes for a Latin American client seeking to ensure they are hiring the right lawyers for a dispute in the region, an authentic Latin American arbitration specialist who will fight relentlessly until the end.” (Lexology). Alejandro is further described as “a strategic thinker,” with “vast arbitration experience” (Legal 500), who is “known in the disputes field in Latin America and beyond” (Latin Lawyer) and “praised for his ability to ‘deliver results in demanding legal battles’” with “leadership, proactivity and experience” (GAR 100).
Many of the disputes he handles arise in complex Latin American environments where legal, commercial and strategic considerations intersect. They often involve governments, regulated industries, major projects and international stakeholders. Alejandro has been involved on pioneering cases such as the first arbitration under the U.S.-Peru Trade Promotion Agreement, a dispute over the first privately financed hydroelectric plant in Guatemala and novel mediation mechanisms to resolve complex cross-border disputes. He also advised on a bet-the-asset legal battle over a transportation concession project recognized as the dispute of the year in Latin America (Latin Lawyer) and some of the highest-stakes disputes in the region, such as the nationalization of the pension funds in Bolivia and the cancellation of the Panama Canal port concession.
Alejandro has represented clients from the U.S. and around the world across jurisdictions, including Argentina, Bolivia, Brazil, Chile, Colombia, Ecuador, Guatemala, Mexico, Panama, Peru, Spain and the U.S. These have spanned sectors such as renewable and energy sectors, gas, construction, mining and metals, airport, highways, irrigation, local communities, telecommunications, environmental, concessions, ports, insurance, post-M&A, compliance and due diligence issues, pension funds, finance and sovereign debt, and crisis management, takeovers and expropriations. Alejandro also advises on structuring investment protections in Latin America and dispute resolution agreements.
He has experience in arbitrations and mediations brought under a range of major rules as well as regional institutions, including the arbitration rules of the United Nations Commission on International Trade Law (UNCITRAL), the World Bank’s International Centre for Settlement of Investment Disputes (ICSID), the Arbitration Rules of the International Chamber of Commerce (ICC), the Mediation Rules of the International Centre for Dispute Resolution of the American Arbitration Association (ICDR-AAA) and before the Permanent Court of Arbitration at The Hague (PCA).
He is a civil and common law trained lawyer with experience practicing early in his career in Argentina and Mexico in law firms and in-house. Alejandro “has a unique profile” with “broad and deep understanding of both civil and common law, that allows him to navigate both legal systems with ease” and “a strong corporate background with deep experience in complex disputes, which positions him at the intersection of transactions, corporate governance, and conflict resolution, with the ability to anticipate and manage conflicts arising from sophisticated cross-border transactions” (Lexology).
Alejandro is also active as a lecturer and thought leader, speaking and publishing widely at premier universities and leading international institutions, and contributing to leading arbitration associations in the U.S. and Latin America.
