Booking/Etraveli: End of the journey, or a new beginning for novel theories of harm?

The General Court has upheld the Commission's decision to block Booking's acquisition of Etraveli, almost three years after the original prohibition. The judgment endorses (i) the position that the Commission is not bound by the specific theories of harm set out in the Non-Horizontal Merger Guidelines, and (ii) that when a merger raises barriers to entry or expansion in a market where the acquiring firm holds a dominant position as a result of the acquisition of assets or businesses in a related market, the merger may be prohibited on this ground.
