Even before the year is out, 2023 has become a highly exciting year for patent litigation in Europe. After many years in the making, the Unified Patent Court (UPC) finally started its operations on 1 June. Following a frenzy of filings on the first days on which the new system was available, the dust settled somewhat a few weeks later.
The UPC has accumulated a fair number of cases by now, though most patent litigation still appears to be happening nationally. The new court even issued its first decisions in the first month, with additional decisions coming out regularly now.
We have therefore included a dedicated section on the UPC in this latest edition of our update, which also comprises summaries of the most relevant decisions from the United Kingdom, Germany, France and Belgium, prepared by our experts.
