Cross-border Patent Litigation Update June 2024

We are halfway through 2024, and the European patent landscape has been active with various key court decisions. Our update on patent litigation cases summarises key decisions from the United Kingdom, Germany, France, Belgium, and the Unified Patent Court. 

A major focus has been on the Unified Patent Court, which has been operational for over a year and shown that it will not hesitate to leave its mark. While current case law focuses on interim injunctions and procedural aspects, we are now approaching the first main action hearings and anticipate the first main action decisions soon. Over the next year, it will be crucial to monitor how the Court of Appeal will handle main actions on appeal.
