Overview

Marcel specialises in dispute resolution in national and international disputes including process management, arbitration and alternative dispute resolution, including corporate litigation, cartel damage claims, complex international contractual disputes, contract drafting (including standard terms) as well as international civil procedure and private law.

Work highlights

His recent experience includes:

  • defending Erste Abwicklungsanstalt against a damages claim of Portigon AG due to tax reclaims by the tax authorities from cum/ex transactions (value in dispute: around EUR 1 billion)

  • defending a European holding and subsidiary airlines in a EUR 3bn cartel damage lawsuit in connection with the air freight cartel
  • representing a former German private bank in a damages claim against former directors and related settlement negotiations
  • representing an international technology corporation in several cartel damage lawsuits in connection with CRT cartel
  • defending an international provider of logistics and services in the pharmaceutical and healthcare sector against EUR 370 million damage claims by various hedgefonds
  • representing an insolvency administrator in complex D&O liability disputes against former board members and advisors (amount at dispute: more than €1bn)
  • representing a leading automotive supplier in cartel damage claims following investigations in Germany and worldwide
 

Professional experience

Marcel has joined Linklaters in 2016 and was promoted to Managing Association in 2020. He was also a visiting lecturer at the University of Helsinki in 2012.

He is a member of the Association of German Jurists (Deutscher Juristentag), the German Association of Lawyers (Deutscher Anwaltverein), the Studienvereinigung Kartellrecht, the German-American Association of Lawyers (Deutsch-Amerikanische Juristen-Vereinigung), DIS40, the New York State Bar Association (NYSBA) and the American Bar Association (ABA).

 

Education and qualifications

Marcel studied law at the Johannes Gutenberg University Mainz, where he also completed his doctorate. He received his Master of Laws (LL.M.) degree from Columbia Law School, New York. He is also admitted to the bar in the State of New York.

He speaks German and English.

Marcel regularly publishes articles in German and English journals and handbooks. Recent publications include inter alia:
