On 12 October 2026, the government launched a consultation on the UK whistleblowing regime, marking the most significant review of the regime since the Public Interest Disclosure Act 1998 came into force in 1999, amending the Employment Rights Act 1996 (“ERA”).

The consultation runs until 8 January 2027 and touches on several key aspects of the ERA framework, from who is protected, to how disclosures are made, to how quickly dismissed whistleblowers can apply for interim relief. It also adds momentum to a conversation that has been happening in the UK over the past few years about whether (and how) whistleblowers should be financially rewarded.

Although a radical rewrite of the law is not being proposed (the government has kept reform of some of the current regime’s most contested features off the table), the breadth of the consultation means employers should be paying it considerable attention.

What is being consulted on?
