LinkingCompetition: EU Foreign Subsidies Regulation Series

The European Commission has proposed a Regulation on foreign subsidies distorting the internal market. Almost a year ago, when protectionism was on the rise globally, the EC published a White Paper. The White Paper identified tools that would neutralise the effects in the EU of subsidies granted by non-EU countries. Today, the protectionist atmosphere hasn’t changed. But have the EC’s ideas advanced?

Linklaters has responded to the EC’s consultation on the White Paper.

In our series on the White Paper we took stock of the powers proposed in the White Paper and the impact these would have on the existing frameworks for EU antitrust, merger control, foreign investment control, trade, state aid and procurement.

In this new series we give you our fresh perspective on how the Regulation will impact each of these frameworks. Our posts will deal with the issues raised by clients and with the implications for M&A transactions and, more generally, doing business in the EU.
