Overview
Harith has extensive experience advising developers, contractors and lenders on international construction and engineering projects in the energy, infrastructure and natural resources sector. Harith’s experience is very broad; he has experience in various onshore and offshore sectors and has in-depth knowledge of prevalent standard form contracts such as FIDIC, LOGIC, NEC, IChemE, JCT.
He is well versed with a variety of procurement strategies ranging from multi-contract procurements to multi-party alliancing arrangements. Clients greatly appreciate the insight he brings to the table on contemporary commercial trends, particularly in the context of alternative pricing models (such as cost reimbursable and incentives-based contracts).
Harith is also frequently engaged to provide construction phase advice on contract administration and interpretation, including assisting with making and responding to claims for additional cost and time and termination compensation under major construction and engineering contracts.
Work Highlights
Harith’s experience includes advising:
- INEOS on the development of a world-scale propane dehydrogenation and ethane cracker facility in Belgium. This role includes advising on drafting and negotiating FEED, EPC, EPCM, technology licence, project management, framework and service agreements.
- a Saudi Arabian developer on overall procurement strategies and drafting and negotiating a range of services and construction contracts for the world’s largest giga project. These include bespoke collaborative contracts (such as target cost contracts, alliance contracts and integrated project management services arrangements) as well as on more standard FIDIC-based construction contracts.
- the designer and manufacturer of small modular reactor technology in connection with its bid to deliver one of the UK’s first small modular reactor projects.
- the UK Government on the construction aspects of the Sizewell C nuclear project in Suffolk, particularly focusing on the review and negotiation of the key supply chain contracts.
- ICOL on the development and financing of a greenfield offshore wind farm located off the east coast of Scotland with an initial capacity of up to 1GW. Specifically, Harith led on the marine installation package.
- a major offshore wind project developer on the termination of a turbine supply agreement including all consequences arising from termination as well as preparing and negotiating settlements in connection with such termination.
- a major offshore wind project developer on general contract administration of a turbine supply agreement, including the administration of various additional cost and extension of time claims.
- an international contractor on claims for additional cost and extensions of time under certain EPC contracts as well as the potential termination of various EPC contracts in Algeria, France and the Netherlands.
- Aquind on the construction, engineering and servicing contracts for the 238km bi-pole electricity interconnector between the UK and France and on-shore converter stations, including preparation of highly bespoke EPC contracts and servicing agreements.*
- IGI Poseidon on the preparation and negotiation of contracts for the design and procurement of a pipeline stretching between Greece and Italy, including for front-end engineering and design, onshore and offshore pipelay, onshore facilities and various supply contracts using a variety of FIDIC based, LOGIC based and bespoke contracts. *
