Pensions Disputes Agenda Summer 2026

Welcome to the Summer 2026 edition of Disputes Agenda.

In this edition, we look at a case on the use of DB surplus for DC benefits and two cases concerning pension rights following a TUPE transfer. We also consider a case concerning restrictions in amendment powers which arose following the Court of Appeal decision in BBC. We have included recent examples of intervention by the Pensions Regulator to protect member benefits, and helpful guidance from the Pensions Ombudsman on overpayment cases. We have also considered Ombudsman determinations on errors in member benefit statements and the duties on trustees in connection with transfers-out.
