Commercial Litigation and Civil Justice Reform

2025 will see new legislation relating to the UK’s civil and commercial legal framework either introduced or developed. In the summer, the Hague Judgments Convention will enter into force for the UK, while later in the year reforms (actual or proposed) to civil justice and procedure are expected to emerge, including those on open justice, contempt of court and litigation funding.

International Arbitration

The completion of the passage of the Arbitration Bill will finally result in a number of amendments to the Arbitration Act 1996, largely incorporating the reforms suggested in the Law Commission’s 2023 report and introducing a number of measures to keep the UK’s principal arbitration law statute up to date. Developments in English case law, fuelled by recent geopolitical events, will also be important to follow in 2025.

Business Crime

The Economic Crime and Corporate Transparency Act 2023 will continue to be a huge theme in 2025, with the offence of failure to prevent fraud entering into force in September. With the Labour government having made clear its commitment to continue to reform economic crime legislation, we examine what other developments we can expect in the next 12 months.

Collective Redress

New legislation such as the Digital Markets, Competition and Consumers Act 2024, will take effect in the coming year which has the scope to impact on a range of trends in the collective actions space. Significant proceedings in the Competition Appeal Tribunal will also be closely monitored, with claims against both Apple and Google going to trial.

Sports Disputes

Financial regulatory enforcement in football was a big theme of last year. In 2025, we expect to see a continued emphasis on governance and regulation in the sport, as The Premier League and its clubs discuss replacing the Profitability and Sustainability Rules regime with a new “Squad Cost Rule” system. The governance framework itself will also be an area of focus with the Labour Government pressing ahead with proposals to implement an “Independent Football Regulator”.
